Under the statutory duty of care, you are obligated to prevent damage to birds and their nests, even if you don't need a permit. A breeding bird inspection is an ecological inspection prior to work that could affect breeding birds.


In the Netherlands, the breeding season generally runs from March 15th to July 15th, but depending on the species, location, and weather conditions, birds may start breeding earlier or continue breeding longer. Therefore, it is not permitted to start work during this period without supervision.


During a breeding bird inspection, an ecologist arrives on-site shortly before the planned work begins to assess whether any nests are (or are suspected of being) still in use. This usually occurs within 24 to 48 hours before the work begins. Sometimes a single inspection is sufficient, but for long-term or phased work, repeated inspections may be necessary.

In addition, some bird species, such as certain birds of prey and owls, have nests protected year-round. Stricter regulations apply to these species, and it's important to prevent disturbance year-round.


If there are no active nests, work can continue. If a nest is detected, the work must be (temporarily) postponed or modified—in accordance with the duty of care under the Environmental Act.
